In late 2013 and early 2014, public assemblies were held to demand “reform before election” and to oust the Yingluck Shinawatra government by the PDRC in Bangkok and various provinces.

On 23 February 2014, around 5pm, an explosion occurred in front of Big C Department Store at Ratchadamri Intersection where the PDRC protesters were converged. The explosion was caused by a 40mm grenade fired from a M79 grenade launcher. The explosion killed three individuals including two children and one adult and caused 21 injuries.

The four of them were sent to the police at the Lumphini Police Station on 15 July. The police requested arrest warrants for them from the South Bangkok Criminal Court on 13 July 2014. Basically, the arrest warrants were applied for despite the fact that the suspects had already been placed under arrest. The police then brought them to a press conference and to carry out a reenactment of crime at the crime scene. Then, an application was made to the South Bangkok Criminal Court to have them remanded in custody on 16 July.

Later, relatives of the four suspects complained that they had been subject to physical abuse and forced to confess to charges during the detention by military officers and such acts could constitute an act of torture by public authorities.

Later, the four were indicted on several charges including premeditated murder, causing an explosion likely to cause bodily injury or material damages, owning and using firearms, explosives, and ammunition for which the registrar cannot issue a license; carrying firearms to a town, village or public way without a license; firing shots unreasonably in an urban area, and violating the Announcement on the Requirement to Prohibit the Carrying of Firearms, Ammunition and Explosives Outside One’s Residence in an Area under the Emergency Decree.

During the trial, the four pled not guilty to all charges insisting that they were not present at the crime scene on that day. They confessed to the charges under torture while they were detained on the military base and during the police investigation.

The case has reached the Supreme Court. The South Bangkok Criminal Court initially convicted and sentenced the four to death on 4 September 2015. Given the benefit from their confession during the investigation and at the trial level, it was reduced by one-third to life imprisonment.

None of the four has been allowed to post bail since when they were initially remanded in custody. The four have been incarcerated for nearly 10 years in the Bang Khwang Central Prison.
