Phattarachai, who was only 14 years old at the time of the incident in 2021, was arrested by police in a neighbourhood in Rama 2 area on 15 September 2021, while playing football with friends. He was accused of being involved in a protest and causing the burning of a royal commemorative arch in Din Daeng on 12 September 2021, around 11:50 pm.

The police brought Phattarachai in for questioning at the Thian Talae Police Station without an arrest warrant. According to the police report, it was described as an “invitation” for questioning rather than a formal arrest. Phatarachai was then transferred to the Din Daeng Police Station at around 9:30 pm, with his mother accompanying him. Plainclothes officers spoke with Phattarachai's mother and recorded their conversation with a mobile phone before scheduling another meeting at the Din Daeng Police Station the following day. They were at the Din Daeng Police Station from approximately 9:30 pm to 2:00 am before being allowed to return home around 5:00 am, when taxis began running again.

Subsequently, on 18 September 2021, Phattarachai was indicted by the public prosecutor without contacting his lawyer, and his family could not afford bail. Given his confession after being charged, the court ordered detention under the Juvenile and Family Court Act, Section 132, Paragraph 2, for six months at the juvenile detention center.
