Jiratwat (last name withheld), an online clothing vendor, is married and has a five-year-old daughter. He was charged with violating the Article 112 of the Criminal Code and the Computer Crimes Act for allegedly sharing three Facebook posts, including one post by an ordinary person and two posts by the “KTUK – Khon Thai UK” Facebook Page during January-March 2021 about vaccine monopoly, the persons who signed off on the Tua Chang, and a speech calling for monarchy reform by "Mind" Patsaravalee during #Mob24March.
The complaint was filed by Pattarawan Khamma, who is a relative of Jiratwat’s wife and was a secretary on legal affairs for the Centre for COVID‐19 Situation Administration (CCSA). Jiratwat’s wife and Pattarawan had an argument and filing a lèse majesté complaint was used as a tool to harass the other person. This case demonstrates how Article 112 of the Criminal Code paves the way for a person to report a case against another person even though the person who reported the case was not the injured party. As a result, the offence has often been used as a tool of harassment.
Jiratwat was convicted and sentenced to three years for each count, for a total of nine years. As the evidence he provided was a benefit to the court, the penalty was reduced by one third to two years for each count, for a total of six years imprisonment without suspension.
