Kanlaya is originally from Bangkok and was leading a successful life with her job. Before her legal troubles began, she had planned to build a house for her parents. However, after being charged under Article 112 in Narathiwat province, she had to travel there frequently. This required significant funds and time off work to attend appointments with the prosecutor and court. Kanlaya entered the judicial process to fight her case starting in mid-2021. Throughout this period, she and her family travelled to Narathiwat to handle the case more than 6-7 times. She has consistently denied the charges throughout the court proceedings
When the trial concluded on 2 August 2022, the Narathiwat Provincial Court found Kanlaya guilty on both counts. She was sentenced to 3 years imprisonment for each count, for a total of 6 years. There was no reduction or suspension of the sentence, but the court granted bail immediately with bail of 200,000 baht.
Later, when the case was appealed, on 27 October 2023, the Ninth Regional Appeal Court upheld the lower court's decision. The Supreme Court then reviewed the bail decision and ordered that she remain in custody during the appeal, citing the severe penalties for the charges and concern that she might flee, despite her lawyer having filed for bail. The court did not grant bail.
Kanlaya has been detained since the Appeal Court's decision at the Narathiwat Provincial Prison, which predominantly houses Muslim inmates and follows the cultural and religious practices of southern Thailand and Islam. This prison is located far from her family in Bangkok, making visits difficult. The prison is currently facing overcrowding issues, creating a risk of disease transmission among inmates.
