“Korn”was charged by the prosecutor with offenses including violation of Article 112 of the Criminal Code and the Computer Crimes Act on 12 September 2024. The prosecutor summarized the incident, stating that on 1 March 2021, the defendant commented under a photo of King Rama X on the Facebook page, “KTUK – Khon Thai [Thai People] in the UK,” which was deemed to insult, defame, and express malice toward King Rama X, the current monarch 

On that day, Korn's lawyer filed a bail application, and the court later ordered temporary release during the proceedings, requiring a bail amount of 90,000 baht and setting six conditions for bail: The defendant is prohibited from leaving the Kingdom. The defendant must surrender their passport to the court, which will be held. The defendant must report to the court every month. An electronic monitoring (EM) anklet must be worn, with the responsibility of keeping it charged at all times to track the defendant's location, and strict compliance is required. The defendant is prohibited from committing any other criminal offenses, particularly those of a similar nature to this case. The defendant must not participate in any activities that could be considered defamatory or inappropriate, which may lead to further legal action in this case.

Although Korn was granted bail, the lawyer was informed by officials that the condition of wearing the EM anklet required a relative living at the same address and registered on the same household registration to sign the installation documents. 

Since Korn’s hometown is in Chai Nat Province and as he travelled alone that day to hear the indictment, he was unable to fully comply with the conditions. Consequently, he was taken into custody at the Bangkok Remand Prison to await his relatives, who would arrive to submit the necessary documents the following day (13 September2024).

On 13 September 2024, Korn’s sister travelled from another province to submit a copy of the household registration as required for bail. However, the bail officer informed her that the court needed additional documents from their mother to confirm that the defendant lives at the same address. They also stated that Korn would be taken out of prison to attach the EM anklet on Monday, 16 September, instead.

As a result of the court's order, Korn had to remain in custody at the Bangkok Remand Prison for a total of five days while waiting to be released with an EM anklet on 16 September 2024, even though the court had approved bail and the relatives had come to submit the required documents during official hours as specified by the court.
